Pressure Mounts To Change Regulations

 

Two exemptions for technology-based small businesses have become recent hot topics for regulators. First, The Federal Communications Commission (FCC) is in the process of implementing the Open Internet Transparency Rule, which requires Internet service providers to offer a range of information about their services, from a complete set of fees to how they handle “congestion management.” 

 

According to the FCC, these transparency rules would allow consumers to compare speed, service, and practices of Internet service providers. Further, the FCC could fine providers for offering misleading information. Small Internet service providers have raised concerns that this level of reporting would create a serious burden, and dozens of Republican lawmakers are asking that a temporary waiver for small Internet service providers become permanent.

 

Second, the Small Business Administration’s Office of Advocacy (SBA) urged the Department of Defense (DOD) to look for alternatives to DOD’s proposal to remove an exemption for Commercially Off The Shelf (COTS) electronic parts. If the rule were to be passed as-is, small businesses would be required to purchase commercially available electronic parts from the original company or DOD trusted vendors. This would mean DOD could trace every electronic part used in products in an effort to fight counterfeiting. The SBA requested that the comment period be extended, the impact on small businesses be reevaluated, and other alternatives be explored.
