Overtime Rules Create a Headache For Small Businesses


Small and women-owned businesses may have to work overtime to comply with updated labor rules. The House Small Business Committee examined the Department of Labor’s (DOL) update to overtime rules affecting white-collar workers in a hearing held on October 8th.


Current law exempts salaried, white-collar employees from overtime pay requirements as long as their salary is greater than $23,660 and their job duties are administrative or professional in nature. The Department’s update, expected to go into effect in 2016, would eliminate the exemption from overtime pay to white-collar workers salaried at up to $50,440, a 102% increase. The Department expects nearly 5 million workers, currently making less than the $50,440 threshold, to become eligible for overtime pay, which could have a substantial financial impact on small and women-owned firms.


Women-owned businesses employ nearly 9 million workers, many of who could be affected by these regulations. WIPP’s comment to the DOL, echoed by the business owners testifying before the House Committee, cited increased salary costs as potentially devastating to non-profits, small, and women-owned businesses.


The concerns WIPP raised in its comments to the DOL were confirmed during this hearing. WIPP supports efforts to modernize workplace rules; yet, the new barriers created by this regulation will ultimately burden women-owned businesses.
